I have two kids from my previouse marriage. Witch was final 4 years ago.. And have remarried and have two more children... I have sole physcial coustody of my two children from my previous marriage.. The noncustodial parent has joint legal coustody.. And was ordered to pay 550.00 a mo. Childsuport... He was also granted standred visation.. Witch I had to find papers and have modifed.. Because He had not seen nor called the kids in over 2 years and wanted to come take them off for his visitation when they dident evan know him... There now 7 and 5 and the only daddy they know or have ever had is my husband... The Modification was done over a year ago they ordered that he could only have supervised visits on the weekends by myself.. And has not had one visit nor made one phone call to check about the kids... He is now 2000.00 behind in childsupport and making treats for me to close the cs case or he is going to harm me... I can't afford another lawyer... But bottom line he dose not care about the kids... He don't want to pay childsuport, Don't call to check on them.. Nor dose he try to see them... How can my husband file to adopt them? Or dose he have to give up his rights? I just want the peace that if something should happen to me my girls will be with a daddy that loves them and the only family they know...

You and your husband file for adoption. I would not recommend doing this without an attorney. The father will need to be contacted and give his agreement to the adoption, but I don't see him refusing since it will end his support obligation. But assuming he agrees this should be an easy and simple process.

In Georgia, abandament is leaving them at a shopping center by theirself.

In Georgia he can not lose his rights because he does not visit, or does not pay child support.

If he pays support, even if behind, each payment is considered a "contact" even if he does not see them.

He will have to sign for the adoption to take place, Since any support stops at that time, most likely he would be gald to sign.
