    Paternity,birth certificates and legal responsibilities in Texas
    My husband signed the birth certificate when my daughter was born knowing that she was not his biological child and has raised her for the past 17 years as his own. We are now in the process of getting a divorce will he have to pay child support on her in Texas?

    So you and he committed fraud on a offiical state document 7 years ago, both in full knowledge what you were signing and contesting to was false, Is this a correct review ?

    But yes he is the legal father and at this point the only person you can sue for support, that is if you get custody, he as the legal father can sue for custody and if the child prefers and he is not a risk, would be granted custody and you would pay him support.

    So during divorce you ask for custody and sue for support from him.

    He can contest and ask for a DNA test ( not sure the guidelines in Texas if it will be allowed or not after 17 years) but that is where you start anyway.

    After 17 years of ACTING as her father, why would he NOT be the father that pays child support?

    Or is he divorcing her and you at the same time? If so, how cruel to your daughter.

    Get support and custody hammered out in your divorce documents.

    If he was your husband at or about the time she was born, then, by law, he was the legal father anyway. So yes he is responsible for support. However, if the child is 17, there is not much time left for support to be due.
