    Me and my girlfriend want to move in together but her ex says she cant because of minor child
    Me and my girlfriend want to move in together, but her ex boyfriend is saying she cannot move another man in (meaning me) because of their 4 year old daughter. They were never married, just lived together. Is it legal if we move in together?

    Where? Everywhere I know, yes. Will the father then attempt to say she's unfit? Possibly.

    I do a couple of these investigations a year. Unless you are having sex in view of the child the boyfriend is not going to win.

    Tennessee. The ex might try that I'm not sure. He is pretty mad about it though. There will be nothing like that in front of the child for sure. He says it's a state law that unless she marrys me she can't move in with me.

    She should ask him for a copy of that law. We'd ALL like to see it!

    The ex boyfriend apparently saw nothing wrong with violating this supposed law but now thinks he can make you adhere to it? Funny. :)

    I suggest you call his bluff. Ask him to cite the chapter and verse of the anti-cohabitation law he claims to exist. I'm betting he will be unable to do so.

    Oh I think I might have forgot to state that the 4 year old is his child. But there is also another child that isn't his. Just wanted to make sure it was all legal before we moved in together.

    All legal UNLESS there's some Order forbidding it and no Judge would sign such an Order so, yes, you're good to go!

    Here you go. T.C.A 36-5-121

    Its part of Tennessee law regarding cohabitation and where it mostly comes into play is when there is a modification for child support or alimony going on.

    As far as custody of a child goes its not applicable. Also there are custody orders written all the time as to overnight visits of the opposite sex. If the custody order has that in it then it would be a problem.
