I was placed on probation about 6 months ago and there was no judgement or stipulation that said that I could not consume alcohol. My probation officer at first told me that I couldn't drink... then a few months later I tested positive and told her that I had been out drinking. She then said that there was nothing saying that I couldn't drink on my probation but just said... don't go out and get really wasted and abuse alcohol and I said... of course not... A few appointments later she pulled some janky on me and told me I showed up positive for alcohol again and got on my and acted like I couldn't drink after she just had previously a month prior told me that I could... My lawyer told me that when he got me the probation in the first place that it never said that I couldn't drink. Now, can I or can't I consume alcohol? And if I do because it doesn't have a judgement saying that I have to remain alcohol free... can she throw the deferred sentence at me in regards to using alcohol with no other trouble whatsoever since I've been on probation? Seems like she's just a complete and in case I do go out and drink again sometime and I test positive... then should I be worried or is she just trying to play that power trip card on me?
