    What if I don't have written agreement only get messages
    I trusted my friend to pay me shortly after loan, since we were in tax season so I felt I didn't need it. So here we are August and still she has not paid. Made a couple of small payments but that was it. So I only have text messages stating that she will pay me.

    So you sue them, you present the text messages, and you show proof of the couple payments made. And tell the judge all of the facts.

    The payments and text messages may be good evidence of the verbal agreement... so you can take your chances in small claims court if the amount is within the small claims limit.

    Well thanks for your advice guy's, I am very stressed and agitated by all this. I really try to keep it cool with her so she can pay me, but I really need my money. Umm one more question... can the court grant me something of value that she can exchange? Shoot I'll b satisfied with a flat screen that she owns... I can always sell it for the amount she owes me...

    No, the court will grant you a judgement against them, If after that, they still will not pay, you will have to try to garnish their bank accounts or pay.

    Even winning in court does not mean you will get paid,
