    Unemployment Benefits & The Law That Protects It
    Section 207 of the Social Security Act (42 U.S.C. 407). Does this law apply to unemployment benefits also?
    If not, what is the name of the Law that protects unemployment benefits?

    Protects unemployment benefits from what?

    Social Security law is Federal Law.

    Unemployment insurance is a State benefit.

    Federal law, of course, supersedes State law, but I do not see Federal law involved with unemployment benefits.

    What exactly is the question, what is the circumstance? Is this homework?

    That clause if I have the right one, deals with garnishment of social security, this has nothing to do with unemployment. That would be covered under state laws.

    Thank you so much for your response. I downloaded this Law in question on Pdf and there was a section within it that covers unemployment benefits, but I didn't really understand it. Thank you again; I will redirect my attention to the State.

    I live in the state of Rhode Island but my benefits come from the state of MA
    I am trying to get the Bank to return my unemployment benefits, which they are illegally holding.

    Recently a levy was placed on my bank accounts. The Bank is holding my unemployment benefits which are exempt. My unemployment benefits are direct deposited. I had a zero balance for over two months until I received my unemployment benefits. I never make cash deposits.

    I have read and was told that unemployment benefits cannot be levied not even through third party by anyone other than the IRS. Unemployment Benefits cannot be held by the Bank to pay legal fees or satisfy a judgment yet here I am seeking answers.

    The Bank has been holding my benefits since 7/24/2012, I have 60 days to resolve this matter. I now have 36 days left or the Bank would have gotten away with stealing my unemployment benefits.
