We are moving out of our in laws home and we want to take the fence that we recently put up less then a month ago. They have signed a piece of paper saying they are allowing us to remove the fence. Can they come back later on down the road and say we should not have taken it? They did not think it is right that we want to take the fence with us but have agreed that we can. I am so sorry I forgot to say please and thank you so much for any help in advanced. I was just trying to keep short. I also live in Houston Tx and a residential neighborhood. That might also help.

If you install a fence that has posts buried in the ground then it becomes a "fixture" on the property and should not be taken. But if they are signing a piece of paper saying that they are allowing you to remove the fence then you shouldn't have any problem. It would probably be a good idea to have their signatures notarized at the time they sign so they can't claim later that their signatures were forged.

Make sure that you return the property back to the condition it was in before the fence was installed. That means filling all of the holes.

You need to keep that paper, if they do not give permission you an not take it, if they give you permission you may. You will need to fix the ground back, fill in the holes and leave it neat. As long as you have it in writing you are OK
