Do you have to request a travel permit from your probation officer? If you do, it would be wise to tell him your kids will be going. You're not forbidden from having any contact with minors including your children are you? I don't see why your probation officer would have any problem with you taking your kids along. I go with my family all the time.

Why does the PO have to know the kids are going?

If the OP has permission from the PO and the other parent - no problem.

I have a client who is on probation for criminal sexual contact of a minor third degree and has court orders not to have any contact with minors under the age of 18, including family. He has to have permission to see his kids or take them anywhere. He must also ask for a travel permit to leave the county as well as permission from his PO in writing that his kids are allowed to travel with him.

Just so I have this right and you know this to be a fact -

Someone has a conviction for criminal sexual contact of a minor third degree. That, of course, is not intercourse with a minor and is (where I live) criminal touching of someone under 13. I am reading that this automatically puts a person on the sex abuser registry.

He is a convicted sex offender (I don't know what level), and there is a Court Order that he cannot have contact with minors under 18 (obviously a State where the age of majority is 18) and that includes member of his family. I've never seen it written that way, I've always seen it to be ANYONE under the age of majority but... when he wants to see his kids, in violation of the Court Order, his PO (probably actually the Judge, the PO just makes the recommendation) gives him permission to do so AND when he wants to take his kids on vacation he has to also get permission for that from his PO, also in violation of the Court Order.

So - even though he is Court ordered not to have contact with minors, including members of his family, his PO (or the Judge) grant him permission to see his children and vacation with them.

I apologize because I forgot that he was placed on conditional discharge for 6 years and a probation period of 5 years. Early discharge from probation in 3 years. He isn't on the registry because of the conditional discharge but he does have to do sex offender probation. He has an ankle monitor with certain conditions like: Cannot go to playgrounds, schools, daycare centers, and certain other things that I cannot remember at the moment. He doesn't have to register though. And this is NM by the way. Age of consent here is 16 but yes he cannot associate with anyone under 18 years of age. His court order forbids him from not only his own kids, but relatives that are under 18 WITHOUT prior permission from PO. He has shown me court documents and a notice that I had to sign that I knew he was on probation and should avoid running around or near parks, schools, daycare centers, etc.

No, no, I wouldn't want his name. I'm just curious about the law, particularly because he can travel with children. The argument is that a sex offender with children has access to other children... and so forth.
