    Fathers rights at the birth of his child
    Me and my girlfriend are having a boy and she is having a c section later in the week. She has been telling me her aunt will be taking my place and I will not be allowed at the birth. By the way this is in Wisconsin so my question is what rights do I have at the hospital? Do I have a say so in who gets to come and see my son at the hospital? Can I get kicked out of. The hospital just cause the mother doesn't want me there?

    The mother is the only one with rights when it comes to the birth of her child. She can choose who she does or does not want at the hospital.

    so what about after he is born as I am the father I am sure I should have some kind of rights as to who she let's around are son. If I think someone is a danger to him that the mother wants to bring around him how would I go about preventing that? Also what basic rights do I have after he is born?

    I'm not so sure you have rights before DNA testingis performed - until then, no, you don't "know" you are the father.

    Where did you read that you have some kind of rights before DNA testing proves this is your child and grants you rights?

    You have no "basic rights" until you go to Court, following the birth, prove you are the father, and are awarded rights.

    Was she dangerous when you were having sex with her or did she become dangerous when she got pregnant?

    (You do realize you're arguing with an RN with a great deal of experience, right?)

    What we say at the hospital... Momma's baby, Daddy's maybe.

    So until you find that this baby is your genetically, you have no rights.

    Frankly you will have almost no rights unless granted by the mother and/or a court.

    Establishing Paternity in Wiscosnin

    If the mother and you sign an acknowledgement of paternity then you will be deemed the legal father and have the rights of a father. If she refuses to sign then you will have to go to court and file for custody.

    I would suggest that when the child is born, you file in your states Putative Father Registry.

    Are you worried about some of your girlfriend's relatives or friends being a problem or even dangerous in some way?

    (This is why couples get married, to avoid this kind of a problem when a child is born.)

    I didn't get that the OP was saying the mother was dangerous. I suspect the mother may have moved on and is in a relationship with someone the OP thinks is dangerous.

    I also don't think he was arguing with J_9, just that he is very naïve in matters of paternity. I wonder how old the mother and father are.

    You're right - he's afraid of who else the mother is bringing around the child, not the mother herself (other than, perhaps, poor judgment).

    Have you noticed a lot of "fiance" or "fiancee" usage? That must sound more serious and committed than boyfriend or girlfriend.

    Some couples DO have good reason for not getting married---bad credit of one half while the other has near perfect credit, for example.

    However... if the OP wants rights to the child he needs to get on the putative father registry and file in court for custody after the child is born.

    He has no rights to be in the hospital, especially if the mother of the child doesn't want him there.
