Filing for divorce Monday morning. My husband is addicted to pain killers and refuses to get help. What can I do to keep our child out of the situation?

File for divorce today, not Monday, ask for emergency custody, PROVE your husband is a danger to the child.

I am out of town on vacation at the moment and will not be back until Sunday. I already have an appointment set with my lawyer. I had all of the proof I needed but broke my cell phone with all of the threatening messages, confessions to buying drugs, but it's all gone since I broke the phone. The only thing I have is a journal from April 8 to date telling how much I know he's bought drugs, how much time he's spent with other people, how little time he spends with us, etc. But I don't know that that would be enough. I need physical proof of how dangerous he can be. I have pictures of holes in my wall where he has got mad and punched them. I just want a guarantee that I can keep my daughter away from drug dealers & from him when he is on them which is basically everyday.

Do you have a protective order against him?

Your Attorney is the person to attempt to keep him away from your child. Your phone's "chip" can't be otherwise downloaded?

Was he buying and using before you got pregnant?

My phone doesn't have a chip. No restraining order. Guess I will just talk with my lawyer Monday and see what can be done. Yes he was using when I met him. I knew that but didn't know how bad it was. So when he told me "I just do it for fun ever now & then" I believed him. Because being young & dumb, I've been in that situation before myself. Never was addicted. Never had any problem walking away from it or turning it down. I made him promise he would quit & he promised. Although he never quit. Not until after I was pregnant did I know he was still using and how bad it was. Once again, time to get married rolls around.. Told me he was seeing a doctor to get help. Come to find out (after we were married) he was seeing a doctor trying to get his own scripts so he didn't have to buy them off the streets to "save us money". That's his version of getting help. Ever since then, I've begged & begged for him to get into a rehab somewhere to get him the help he needs but he refuses. And I have no support from any of his family to get him help. I'm fighting a losing battle.. And I'm fed up with it. So yesterday when he told me he had no feelings for me & didn't love me or want to be a family anymore, I decided it was time to see my lawyer & let her handle it from there.
