    Incorrect police report nj civil matter
    A police report was made by an officer that was regarding a civil matter. After reviewing the report I realized that there was incorrect and misleading information demoralizing my intentions at the time of the incident. I contacted the police dept and explained the situation. I explained to a sgt that the officer had left out crucial facts and had also had not documented the correct information. The sgt down played all of the mistakes and said that it wouldn't matter in court. I asked for the report to be corrected anyway explaining to him that this was a civil matter. The questions I have are: can the police dept be made to correct the report and what action can I take legally against the officer. The officer that wrote the report has on several occasions been bias towards me . This matter all revolves around a finalized divorce that I had.

    No they cannot, and there is no action you can take. Maybe if you could possibly prove that he deliberately made false statements, you might have a case, but that's a long shot.

    A police report is generally made after the fact and the police did not witness the incidents. So the police report will be of little value to either party.

    Police officers are not, in general, Pulitzer prize candidates. It's just a report. Not necessarily true or complete. If it doesn't say what you want it to say, get another witness.

    Nor, apparently, is the OP - anyway, unless the OP can PROVE the Police Officers' deliberately filed a false report there is nothing he can do.

    I get into this "discussion" with people involved in MV accidents all the time. The Police are always biased against them, the report is slanted in favor of the "other guy."

    In general it is impossible to get a report corrected OR a second, correcting report filed - even if the info on the original report is incorrect. The report is going to matter little. Testimony is what will matter IF/WHEN the matter gets to that stage.

    Why are the Police biased against you, particularly if they were at the scene of the incident? Why would they deliberately file a false report?

    How did that happen? Usually the police are called to the scene and are not on hand to witness everything.
