    Unsure about our rights
    Me and my wife bought a trailer in sept. 06. We have been remodeling recently. We have discovered that there is black mold all through the place. For months now me and my family have been sick. We show all the syptoms of toxic poisoning from mold. We have spoken with neighbors who say they believe the landlord knew prior to our purchasing. We also talked with the property manager and when we told her of our discovery she said "oh I'm sure there is. This leads me to believe they always knew. Also they had done some work we find out due to leaks and rotting floor boards in the bathroom. Their solution was to lay carpet over it in the bathroom. We have found a very nice place for sale and are going to take it, but we still owe 2500 on this place. We really need to know what we should do, as well as what we can do. If possible we would like to get some money back, but also make sure that another family doesn't get this place without being informed. We are in a contract for title if that changes anything.

    You need a RE attorney to review your purchase documents and determine if the MH sale required a mold disclosure... if it did, then you may have some luck... who do you owe the $2,500 to - the seller or a bank/finance company?

    You need to prove three things:
    1) That the sellers were aware of the mold condition
    2) That the mold condition has damaged your family's health
    3) That mold condition makes the home uninhabitable

    If you can prove all three, you will have no problem getting out of the contract without owning anything more and should be able to recoup money you paid. But you will need to hire an attorney to manage the case for you.

    If you don't want to hire an attorney, default on the loan, let them sue you and then present your evidence.
