    Charged with theft and fraud under $5,000, will I be arrested?
    My mother ran a sports league at a legion and handled the money. My mother had borrowed money here and there from the league money with the intention of paying it back before it was time to hand it over at the end of the season. When the league ended she was unable to come up with the money that was due back to the players (for prizes, etc.). The amount owed was approx $4,500. When the money was due back to the league players, she explained what had happened, most seemed to be forgiving and understanding, my mom assured them that the money would be paid back to them as quickly as possible.
    The legion banned her but washed their hands of the situation and will not press any charges.
    A woman from the sports league has now sent my mother a threatening email. She named several people in the league (none of which are actual members of the legion) and advised that if my mother did not pay back all funds within two weeks, they would be pressing charges, she advised that they've already spoken to the police. Can these dart league players charge my mom? What is this type of charge, theft or fraud? What type of punishment would she get? She's 58 years old, has been on disability for about 15 years and is having knee replacement surgery in August. She's has been an emotional wreck since this whole thing began and this email threat has just made her worse. She has no criminal record. She will not be able to pay back the full amount of the money for several months, likely this can be done by the end of the year.

    She understands that she will be charged and she is terrified of the possibility of going to prison but I expect that due to her age, lack of record and the small amount of money, she will not need to worry about jail time, am I correct in thinking this?
    One of her biggest fears right now is that the police will show up at her house and arrested her, will this happen? Or will she just receive a notice to be in court? Is there a way to avoid her being arrested…like by turning herself in before they come to arrest her?

    Maybe with a good attorney... But, if she could afford one of them, she could pay the money back.

    The league, the people in the league doe not decide to charge or not to charge, the DA will decide that, if reported to the police they will go question the league officials, question other parents and give their info to the police.

    *** if the police were notified, this is most likely already happening.

    Most likely these other people just want the money paid back, So if she will just pay them back NOW, most likely it will go away. So she needs to sell things, pawn things, borrow money, and pay this back.

    Next sorry, she did not "borrow" a little money here and there. She stole the money, since she did not have the right to "borrow" the money.

    If she is arrested, yes they may do it at home, or at work, or if she is driving down the road.
    She will be put in jail and held at least over night till bail is set. She would stay in jail till someone pays her bail. If they set bail at 50,000 dollars, a bail bondsmen will want 5,000 to get her out So since she does not have that money she would set in jail till trial.
