    Child support incorrect tax used for calculations
    Hello,

    My ex-husband used his tax return for 2011 that had several incorrect filings and deductions, around 700,000 not claimed and after deductions was around 50,000 taxable income. His child support is around 650 month and he has filed again to have it reduced again and is claiming over 150,000 in extra deductions giving him a 40,000 taxable income. He submitted his 2010 and 2011 tax return "for clairety as to his deductions", I submitted information showing were he claimed wrong deductions from public record search. My question is can he be made to pay the amount he neglected to claim last year in a modification to child support hearing?

    I don't know where you are. In NY, yes, if support is based on fraud, you prove the fraud, support goes to what it SHOULD have been and the "ex" owes the difference.

    But - you need to PROVE your allegations.

    Sorry about that, we live in Alaska. I submitted the paperwork for a house sale for 1.4m that was purchased and sold in 5 days, quit claim deeds submitted. He claimed he owned the property since 1969, he would have been 4yrs old, and showed a lose for the house and their fore didn't pay any capital gains and shown a lose as well. That property had been purchased and sold by him 3 prior times. Claimed head of household even thou kids live with him less than 50%, the list is long. The last child support modification we submitted the legal paperwork for the property sale along with deeds and selling price, the judge simply didn't commit on the request. It would have cost me more to fight it that I would have gained.
    With the child support modification coming up in 3 weeks is there something I need to do to address the over sight in the last modification? Need advice.
