    I assume your husband draws his pay from it... and they can order that garnished... and cause the business a great deal of problems, (revoking its business license among them, audits, etc) if they refuse to comply. Even if it and your husband are one in the same.

    I assume YOU are behind on the state taxes and NOT your husband.

    If so, they can STILL garnish the assets of the company IF you filed JOINTLY with your husband in the years for which you are behind on the state taxes.

    If, however, your husband has consistently filed MARRIED FILING SEPARATELY, then perhaps his business will be spared garnishment.

    You need to get advice from a LOCAL tax professional on this.
