Is there a minimum amount for small claims court
My husband does landscaping on the side of his full time job. In the 15 years he's been in business he has never had a dissatisfied customer, until now. This woman is very difficult to reason with, and doesn't have a very good handle on the english language.
She wanted him to install dusk-to-dawn light fixtures at her home. He told her he was not a licensed electrician and she told him to do it anyway. After he installed them they didn't work. He told her he felt a licensed electrician should look at it because he felt there was a wiring problem.
Now flash forward two months, she calls him and yells at him because of the edging and mulching he did, (not because of the lights) which he has receipts that he did the work, wasn't satisfactory. He tried to explain things to her, and she couldn't understand.
We sent her a certified check and a certified letter stating that he felt there was issues with her electric wiring and a check for the amount of the installation for the lighting. We sent her copies of his invoices showing that he had did the edging and the mulching too. We didn't include the amount for the landscaping he did because he DID the work.
Now she's threatening to take him to small claims court because "it's the principle because he didn't apologize"? My question is, is there a minimum for small claims in Indiana (I know the maximum is $6,000).
I'm trying to determine if we should just pay her (even though we've tried to work with her), or wait for the court date since we have documentation for the work he had done (receipts, etc)? Sorry for the long description but want to give everyone all the details. It's around $300 that she's asking for. Which she is ballooning the amount as well.
