    Alimony modificaton
    I am 61 yeas old , was married 32 years. Now divorced 10 years, husband asking for modification due to change of wages.

    My health has been bad over the marriage and now has deteriated worse over the 10 yrs. I cannot find work and ,he is trying to get it terminated..
    I only have the 2,000 a month I get from him

    I'm not a legal expert, but I have to ask. If his wages have been decreased, that also affects him, and his ability to live.

    I understand that you're ill, but, should he go without food or shelter, when his wages have decreased, so that you can be comfortable?

    I don't think that this is fair. In today's economy, many people are unemployed, or taking a pay cut. Seems like he's in that boat. Doesn't seem fair that he's working, for less than he used to, but you still expect him to pay what he was before. I think that the courts should consider the wage he's making now, and allow him enough to take care of himself, since he is the one working for the money he makes.

    But, I'm not a legal expert. This is just how I see it. How much of his earnings do you expect? What illness do you have that is making it impossible for you to work?

    I have to add. Two thousand dollars a month is double what I make working full time.

    It is very possible that he can get it reduced or even end, You have a right to fight this in court with an attoreny. If it was me, I would be looking for a job.

    I would think that since you are 61 and if in CA you will be eligible for Social Security and since you are having problems with illness then you also will have medical coverage. You might check into taking it early and I think the age is 62. You will draw off his Social Security although it will not affect his benefits at all.
