    Were my rights violated under HIPAA?
    I was diagnosed with the flu and reported this to my supervisor. The same day, an agency-wide email was sent out by the COO, telling everyone that I had swine flu and that they should be tested. I was surprised that she specifically named me and disclosed my diagnosis to all employees. I immediately thought of HIPPA and was wondering if my privacy rights have somehow been violated?

    Unless you are in healthcare, she did not violate your HIPAA rights.

    She did however use extremely poor judgement and cause undu anxiety amongst the staff. Assuming you want to continue working there, I'd probably schedule an appointment to discuss this with her and your HR person. If you are satisfied, end it there.

    From the Health and Human Services web site:

    "The Privacy Rule does not protect your employment records, even if the information in those records is health-related. Generally, the Privacy Rule also does not apply to the actions of an employer, including the actions of a manager in your workplace."

    I'm not a lawyer, but am in the health care field.

    I need to know is department of HR are supposted to now that I have been diagnostic HIV because I went to do the test to department of health and they use a number for my case and located me by a number because this is highly confidential.AI am very disappointed with the decision they did with out my consent.Even the contractors know my situation.
