My wife and I bought our home about 4 yrs ago when the housing market in saskatchewan boomed. We bought it privately as the seller stated he had no intentions on selling the house through a realtor. Odd? Maybe you but we gave the seller the benefit of the doubt. It wasn't even the actual owner that sold us the house but his son in law! The son in law told us his wife's father had a lot of sentimental value to the house because he saw his family grow in this house and had recently lost his wife. We bought his story very easily and did not question as to why the owner wanted no part of the sale. Odd? Anyway, to make a long story short we just found out we need to trench around the house and brace the walls. We also paid a company " Got Mold?" to get rid of mold in our basement walls in one of the rooms. Half of the room was done with vapor barrier and the other half wasn't? Guess which half we found the wall? We can actually see where the previous owner patched up the cracked walls but failed to patch the room next door where the water main pipes are! We can actually fit a toonie through the cracks.
My question is. Should the owner have disclosed the crack(s) in the small room where the water pipes are instead of just hiding the visible cracks in the room next door? He chose not to tell us so he could get the full asking price. Do we have a case?

No matter who you dealt with the paper work to be legal had to be signed by the owner of the property. ( or approved agent and/or representitive)

So if you can prove they knew about the damage and problems and did not notify you, then you may have a case. Also did you have the home inspected, that will be another issue, if you accepted it without inspection, that may also be an issue.
