    Tenant moved out claimed mold
    My tenant never paid rent or deposit. Gave me a Che k for less than a month's rent that bounced, She then claimed that she and her dogs were sick due to mold and had a "professional" declare the apt. Unfit to live in. I had the apt. Check... no mold. She moved out without letting me know due to the mold she claimed in a complaint to the code enforcement. She has been gone three weeks and left a pair of men's shoes and a shirt behind. I had given her an eviction notice. Do I need to proceed with the eviction or am I safe to rent the apt?

    How long was she in the apartment? If she was there for 30 days or more it qualifies as "tenancy" and an eviction notice would be necessary IF she were still there. She abandoned the apartment if I read you post correctly. Is she receiving mail at that address? Does she have utilities in her name at that apartment? I think that YOU could take her to small claims for not paying rent but even more, you can just file a complaint with the Sheriff's Department in your county and they will arrest her for writing a bad check. That is your best bet.

    She moved out after you gave her an eviction notice. Sure, if she moved out, she's out. Find another tenant.

    This is in Florida. The reason for the quotes around professional is because that how she referee to the company which was out of town . She supposedly paid to have the inspection for mold, but bounces rent checks.
