[Unhappy Sellers]

We have a 10 month contract with our Realtor couple who are residents AND sole realtors in our 55+ Park. They both signed our contract and because of an incident with the wife, she now refuses to work on or show our property.Consequently it is not being shown,and 3 other houses have been sold during this time and have not been shown our house. Although the husband says his wife's feeling don't influence him we don't think we're getting a fair shake. Do we have to pay their full commission when they sell it? Beverly >email address removed<

Yes. There's no 'half a contract' here. You either get out of the contract and find another agent, or tell them you are going to sue for lack of showing your place to the documented buyers. You will need proof from them that they weren't shown your place and why.
I have never heard of such a thing as sole realtors anywhere, unless you signed something to that effect when you bought.
You can also file a complaint with the state licensing board.
Your best bet is to get our of or renegotiate your contract with rumblings of reporting them (which may not hold much weight). 10 months is unusually long too; I have never seen more than 90 days, although I suppose these days with houses taking longer you might see 4, 5, or even 6 months.

With that in mind - does the contract address less than full commission OR your ability to withdraw from the contract?

If you intend to sue them - and this is in a legal category - you would have to prove that the residences sold were almost identical, at least comparable, to yours.

As my colleague, "Joy" said, you can't have half a contract.
