Hello, I'm having trouble with lanlord I moved in 3 monthes ago went to great lenghes to get this apartment and now its been over a month I been having a nasty smell of food from dumpster and water this smells as attracted flies I'm on the 7th floor the smell is so bad in the hallway that flies came in and now are in my apartment I wrote the hov. About it they did not respond back I tried telling my lanlord and she's been having her realter deal with me because she doesn't speak english the realter doesn't want to help anymore and we tried calling the lanlord she won't return calls she doesn't have a email so I had to hunt her down at her job with the realter I had to go in first and realter after so the lanlord would not hide beause she's been ignoring her own realter for whatever reason I'm not sure so I went in then realter and I explained she did not care how I felt or that this is been going on she said to us this is my problem you have to deal with this to the realter then she srated screaming at the realter and I'm like what she's my lanlord it is problem so I told her you what I want to move I feel your in defualt you don't want to help me you don't care your blaming the realter when its your property I paid on time I'm not due for rent yet I want to move right now you keep my last month I will take a loss I'm just asking for my deposit she then stormed away had her husband come out and he told me I have to call my attorney he has not called me yet its been three days... I want to know if I'm right and can I brake the lease beasue of this and keep my deposit

What is the hov? Also where is this, laws vary by area. But generally, if you can show you have an uninhabitable condition, then you can break your lease, but you have to make sure you do it right, and just complaining to the landlord isn't sufficient.

Have you called the local Health Department and complained?
