    What type of case is it ? What do they owe the money for ?

    But you go down to the small claims court clerk and fill out the paper work and pay the fee to file. Once the other person is served they will set a court date.

    At court you win a judgement, getting a lien is often about the last thing you want to do, since you don't see any money till the home is sold. ( that can be years and years) Beyond that, there is a homestead exemption in some states ( in the US)

    Or, to put it another way, don't count on the lien working by itself to get what's owed you. At the same time you file the judgment lien, you will want to enforce the judgment more aggressively as well, by executing on property belonging to the defendant, and garnishing money owed to the defendant.

    You can do all of these things at once.
