    Judgement against social security deposit
CAN CREDITOR SUE FOR SOCIAL SECURITY MONIES
I am a 75 year old woman and my husband is 68--he is now in long-term care in a nursing home. We returned one car to the credit union after having it for 10 months and making payments early each month. I received notification that the credit union was suing us, but they never told us how much they received for the returned vehicle. Can they take our social security money from the checking account? We have no savings. We purchased a home 4 years ago and have 26 years to go before it's paid off. Can they take our home? We have no other assets.

Your SS cannot be touched for other than very specific debts - primarily child and spousal support. If money is co-mingled in an account (savings and SS, pension and SS) there will be an argument about what is protected and what is not.

Yes, the company can get a Judgment against you. It would make little sense for them to move against your house.

This is very general info and the Judgment part/seizing assets varies by State.
