    Child support rights to mother and father
    I have one one child and one on the way, their dad wants rights to them but I do not want them out of the state, is their any way we could still file for child support and him not be able to take them out of state?

    Not unless you want to take the chance that he will now decide to file for custody which is his right to do as a parent. This goes both ways... both parents have equal rights.

    You need to have an attorney prepare an agreed order for custody and child support, to be filed in court and signed-off on by a judge. This ordr (or judgment) can include, among other things, a priviso that he cannot take the children from the state.

    You filing or not filing for support has nothing to do with his rights to custody, and to visitation.

    If you never file for support, he can still file for custody, joint custody and/or visitation.

    Unless you can prove he is a risk to the child, and that he has to have supervised visits, it is doubtful that the court would not allow him to take the children to his home for visits.
