    Stepparent adoption
    I have a daughter that is 10 and have filed a petition for stepparent adoption. I have filed all forms and served the bio. Father who has not seen her in 9 years, who has over 13,000.00 in back child support due, and is incarcerated until 6/2019 with a parole hearing 02/2015 he is considered a violent offender. After being served wrote a letter objecting to the adoption, why I will never know because he has completely abandoned her since she was 3 months old in my tummy. But I got a letter from the court saying I needed to file an amended petition for adoption which seeks to terminate his rights because of the objection letter he wrote. But the only form I can find is Form 12.981(a)(2), Termination of Parental Rights Pending Stepparent Adoption: but was deleted out of the system in 2003 by legislation, so what form do I use or how do I amend an existing form?

    File the form, with a cover letter explaining that
    1. the court insisted (copy enclosed) upon an amended petition;
    2. form 12.981(a)(2) is also enclosed for filing;
    3. the form indicates it was "deleted by legislation"; and
    4. ask for a clairification.

    I suspect that the webmaster is not aware that the form needs to be replaced.

    And this is why we do not recommend pursuing an adoption, even a step parent adoption, without an attorney.
