    What's on my Background Check
    I recently took a plea agreement that suspended charges against me dealing with a felony. This was the first charge that I had in my 36 years of life. The charges were all suspended and I just wonder will they show up on my record. I am on probation for three years but my officers said after a year he will sign me off because he understand that I was in the wrong place at the wrong time. I also had to pay restitution and court fees that I am stilll paying on. I am a full time student trying to complete my Bachelor's Degree. I have had nothing but trouble trying to find work. I have been unemployed for two months with no luck finding work. Is there anything that I can do to get the charges off my background record?

    Hello l:

    Couple things.

    ALL the charges weren't suspended, because you plead guilty to something. Maybe what you plead guilty to is stopping employers from hiring you. I don't know. While you're on probation and for several years thereafter, you won't be eligible for an expungement, if expungement is available in your state.

    It can't be both ways - charges can't be suspended AND you can't take a plea deal.

    Expungement cannot be obtained for a number of years, according to the State.

    This is lavonde. My attorney offer me a plea agreement. I took the agreement. When I went in front of the judge all my charges were read. The District attorney along with my attorney had all charges suspended. I did not serve one day in jail for any of these charges. The judge suspended all the charges and placed me on probation and to pay the restitution fee and court cost.

    Hello again, l:

    I know you don't understand, but try... You can't be on probation unless you've been convicted of a crime. There is NO OTHER possibility.

    Therefore, you WERE convicted of SOMETHING. Maybe it was a misdemeanor, but it doesn't matter. A conviction WILL show up on your background.

    There is no such thing as suspended charges. If charges were DROPPED you would not be on probation, there would be no plea deal to anything.

    If charges were NOT dropped you entered a plea to something and in lieu of jail time you are on probation. You could have spent time in jail - instead you were placed on probation. If you violate probation you will go to jail.

    You have to call the Court or your Attorney and find out what the details were because you obviously didn't understand the plea deal that you took.

    Yes, your charges and the fact that you are on probation will show up on a background check.

    Maybe you got a suspended jail sentence or you are in some diversion type program.Like Judy said probation is in lieu of Jail time and means that you plead guilty to something. You can get a copy of the disposition from the court and ask them or your lawyer to explain it to you.
