    Probate law
    My Mother passed away in 2008 since then it has not been brought to probate, while she was living and I was with her my stepfather had taken her to an atterney to have her will redone, one thing she said to her three children and her husbands only daughter was that in her will bob will remain in her home until he passes and the house and everything in it was to be actioned off and we were to split the money, my sister is the executor of the will she had no idea of the other will my mom had changed 2 months prior to her death, when she passed my step father hid the will and used the old will my sister had, since then he now said he had the will changed and my brother is out of the will and none of us is getting nothing because he is so far in debt drinking and taking cruises that he has no money and we have to pay his bills when he dies I really need some help, Im on disability and can't afford an attorney and don't know where to even start from here, I called probate and they told me they have no will on file for my mother. Please someone help me.

    You need an Attorney.

    You appear knowledgeable about the Wills. Contact the Attorney who prepared them.

    What she SAID does not matter; it's what she wrote in her Will that does matter.

    Have you actually seen both wills? If you were named in it then it should at a minimum have been read to you.
