    Husband forced to retire - on Soc Sec - credit card debt - creditor now coming after
    My husband was forced into retirement 6 years ago. He retired and has been drawing Soc Sec. (We lost 75% of our income.) He had a JC Penney credit card which he stopped paying on. That card was only in his name. They are now suing me in court for payment. Can they do that?

    ANY question on law needs to include your general locale as laws vary by area.

    In some areas a spouse can be held responsible for debts incurred by the other spouse during marriage.

    1 Are you sure you are not on it.

    2. where do you live, is it a community property state ?

    3. Are you sure they are suing you, or, are they just threatening to sue you, you can tell if most collect agencies are lying, because their mouths are moving.

    How or why was he forced into retirement, if he health is OK, why does he not get or find another job ?

    3. Quite sure - trial date Monday. Husband went to court last Oct - judge ruled since he is on SS they couldn't get money from him. So they sent me papers subpoenaing me to court when they found out I have a FT job.

    Corporate travel agent - Travel agency terminated all employees ages 58 and up - can do that in the state of TN. Husband is now 70. Works PT as a Customer Service agent at our local mall. Had quadruple bypass surgery 2 years ago. A TIA 5 years ago. No straight-ahead vision in his left eye. I keep trying to get him to look for FT work. With his age and many rejections, he is not very aggressive in that search. I work a FT job and a PT job.

    I think the problem will be what the card was used for. For example. If they can show that the card was used to purchase things like woman's clothing they may be able to show that you used or benefited from the card. Its by no means a slam dunk, but judge may rule that way.
