    Were my HIPAA rights violated?
    I went to the emergency room because my I fell and my wrist was very swollen .they called me into a room right away .the doctor walked in and asked what had happen. After me telling him that I had fallen he then asked me what kind of pain meds would I perfer .I told him. And he then told the nurse to give me the pain meds I wanted .she did then asked me to wait in the waiting room which was packed . They called me for some x-rays of my wrist after the x-ray I was told to sit back in the waiting room . Then hours later the nurse comes out with some papers and tells me to go see a specialist gave me a priscription for more drugs and I never got to see my x-rays or the doctor plus gave me a blank paper which I can fill out just in case I wanted to stay out of work I can write out my own time off.now this was all done in the waiting room with everyone around .I believe that I should have been called back into the room and told what I needed to do.instead of in front of everyone in the waiting room .I am paying out of pocket for this serves. My hippa rights were violated.am I right or wrong?

    As you case or symptoms where not discussed with a third party your rights where not breached.

    Sorry but you are wrong. The treatment you received is typical of a busy ER. Unless your diagnosis and treatment were discussed directly with an unauthorized third party, I don't see a violation.

    But even if a violation did occur, what do you want done about it?

    Firstly, it is HIPAA, not hippa. As a registered nurse I primarily work in labor and delivery, but I also work on an as-needed basis in a very busy ER. It is not uncommon to triage a patient, or treat them as you were treated when the ER is full with more urgent life threatening illnesses. It is also not customary, or necessary, for the doctor to show you your x-rays. Many ER's are now computerized and the x-rays pull up on a computer rather than the old fashioned films that we are used to. This would make it impossible to show you the x-rays.

    I don't see that a violation occurred here as your diagnosis and treatment were not made public. You were only given a prescription and told to follow up with a specialist.

    If you are hoping to make some quick cash for what you think may be a techical violation of HIPAA, forget about it. Money damages is not what HIPAA is all about and you were not damaged anyway.
