I am being sued for medical bill that date back to 2003-04. I was married previously. My bank told me to check my credit and to dispute any item that is older than 7 years. I did this. When the company contacted me to get me to pay the bill over the phone. I asked repeatedly to have a copy of the bill sent to me and I gave my correct address. I was told several times that a bill was sent to me previously. (In 2008 to an addressed that I moved from in 2005). I then was asked to pay by bank check. I told the lady several times that I did not want to pay money to a company I was not even sure the bill was mine or not. I know this bill was incurred during a marriage that ended in 2007.

When the court papers came, A portion of the (biggest portion) has my ex husband
's name as pt and person responsible. A smaller portion has my children listed. I have know way of know if this was paid by insurance 10 years ago. Why am I being sued and not my ex too. Help?

Possibly because your ex can't be found or can't pay. So you respond to the summons with an Intent to Defend and you ask for a hearing.
