    Theft under $5000, second offence ?
    I live in Ontario, Canada. When I was 12, I stole from Walmart and they called the police on me . They let me go with no warning or fine but I think I might have got a record, I'm not sure . Being an idiot I am, I stole again, this time they gave me a court date and to go to the police station to get fingerprints . I'm 15 at the moment .

    I'm just wondering what can the outcomes be in court ?
    Will I get a criminal record ?
    Will universities/colleges/jobs know about it ?
    Will I need a lawyer ?

    You need to sit down and discuss it with your parents, since it will be their money paying the fines. No there is no police record if the police where not called and you did not go to court.

    Most likely you will be given a diversion program, the store will get about 300 to 500 for a civil penalty and there will be a fine from court most likely for about the same 300 to 500 dollars.

    Dear Fr_Chuck

    Sorry I left out some information, my parents know about it . First time I didn't go to court but the police WERE called, second time the police were called and I'm going to court .

    Also, is there a possibility that I will not be able to get the diversion program because of my first offence ?

    Yes, if your first offense is on record you are not eligible for diversion. The place your stole from also has to consent. If it's the same store or chain they undoubtedly still have the record of the first time you shoplifted.

    Apparently your experience three years ago didn't teach you anything. If anyone realizes that I would expect you NOT to qualify for diversion.

    If you are ever asked if you've been arrested, you have. That includes Colleges and Universities and employers.
