We bought a brand new mattress and box spring set from Mattress Outlet in Spring Lake,NC and after sleeping on it a couple night the middle popped up like an egg. I canned the owner of the store and he came out that weekend to take a look. After seeing,feeling,and testing it out he admitted it had a malfunction that was not caused by us and that he could tell it had not been mistreated or damaged from use. He said he would trade it out form another one after he talked to the manufacture that week. I waited a week and called him again he said the manufacture would be coming by that week to talk about it. I waited another week and called again (today) and he said he should be calling him today or tomorrow. After letting my fiancŽ know we would not have this resolved anytime soon he called and asked for a refund.He was told there was no refund policy. Is there anything we can do or are we stuck with this horrible mattress set? We have had it less than 30 days and still have the receipt...

Is this "no refund" policy posted in the store? If it is it may very well not cover defective merchandise - which this obviously is.

What would I do? I'd file in Small Claims Court IMMEDIATELY.

I'd also call the Better Business Bureau and report this.
