My daughter in foster care
I have a one year old daughter who has been put into foster care. Our daughter has Failure to Thrive and has had congenital cataracts with both lens removed (Right eye is very Underdeveloped) at 5 months, She has 80% chance of getting glaucoma. She has been involved with infants and toddlers for most of her life. They document her as being hypotonic with significant delay. I had a scheduled C- section birth after a complicated pregnancy (Single Artery vessel, Strep B), Also was high- risk. Of note we also have an autistic 12 year old from the same union.
In early January, We were feeding her when she bit down on a spoon and loosened a front tooth. We had also noted swelling of the left femoral area. Long story short, go to pediatrician about the leg and the tooth. Pediatrician refers to U of MD. CPS is called and child admitted for spiral fracture of the left femur, fractures of both elbows and other fractures in various phases of healing. My Daughter is in foster care now.
We have said over and over that we did not abuse her. We are adamant and believe that it is a congenial bone disorder. At UM, orthopedic was consulted, as was genetics and metabolism. There was nothing to suggest anything other than a non-accidental injury. However, and granted, I got the feeling in reading the record that abuses was a foregone conclusion in our child. I didn't see any skeletal surveys or bone density testing or any other bone testing. That is why I am turning to you.
As of March 5, 2012 we saw our daughter this day she looks worse than ever, Her leg looks swollen again and we believe that her leg is broken again, We believe Child Protective Services are neglecting the fact that there is a underlying medical problem and they refuse to have here seen by the proper doctors, Even the foster mother and supervisor at Catholic Charities believes there is a medical problem with my daughter. Seems like the Child Protective Services are just looking out for their monetary gain in receiving adoption Bonus and not the welfare of our daughter.
Also as of note, we have notified her doctor and Infants and toddlers of our concerns many times for her bruising and skin condition, her feeding issues and her eye sight and other developmental delays and to this day she continues to have bruising, she has had a bed sore on the back of her scalp since November 2011 and still is there as of March 5, 2012.

I don't know what you want us to say; we can't help other then make suggestions for her care; suggest legal options.
How old were you when you gave birth? Was this a late in life delivery?

Have you contacted a lawyer? You need a lawyer to help you fight the legalities of this situation.

I was 33 when I delivered her, and I have a Public Defender, I have tried to get her care all her life.

Hi casper64,
Was there any growth restriction as a reason for the c-section? Was she born prematurely? How was she being fed? Was she on any supplements? Any family history of bone disorders, or dental problems?
I wonder if getting together with the foster mother and the director of Catholic Charities as a united front when addressing CPS would be of benefit. Is the foster mother going to take her to the doctor to check her leg? What has your public defender said about your options? I would definitely voice your concerns regarding a skeletal survey.
I hope your public defender can help with your situation.

The reason for the C-section is I had a previous C-section and I have had several laprocopsy's, She was not born premature. She was bottle fed. She was not on any supplements, and we have fibro, RA, Degenerate joint diaease in family. They have recheck her bone and the quack othro said they were fine. We are in the process of getting an expert from Hopkins.

I would like to say stay strong you obviously know and care about what is going on with your baby girl now its time for some serious mom kicking a** get a good lawyer not just a public defender but someone who is aggressive document every little thing which I see you have. Don't take no for an answer you are her mother and you are her voice stay strong stay healthy so you can get through this with her. You can do this I don't even know you and I have faith in you anyone who has taken the time to figure out every avenue for there child to be safe and happy I have faith that good things will come to you.

You need to get a medical expert to confirm that her issues with fractures is due to medical deficiencies, not abuse. Your lawyer should be doing that. Armed with that diagnosis your lawyer should file for CPS to end foster care and return the child to you.
That is the process here and the only advice we can give other than to keep up the good fight.
I do have to comment on your contention that CPS is doing this for monetary gain. That is just ridiculous. CPS is a government funded agency, any stipend they get for caring for a child comes out of taxpayer dollars so there is no monetary gain. On the other hand, CPS agencies are notoriously overworked and it may be easier to just use foster care than deal with the real issues. That's where your lawyer comes in, to force them to deal with those issues.
