Undoing acknowledgment of paternity papers in PA?
Hi, I had my little girl back in feb of 2004 me and her bio father broke up when I was 2 months along I meet my now hubby when I was 3 months along and he has been her dad for the past 8 years her bio father never wanted anything to do with her and never signed anyhing for her I last time I talked to him was when she was 1 me and my hubby got married in oct of 2008 and June of 2009 he signed acknowledgment of paternity paper even though his not the bio father I have 2 other kids both to my hubby my little girl doesn't know anything about her bio father and thinks my hubby is. The problem is she has been getting really sick latey and the docs are un sure what's going on and had said for her dad medical stuff and I don't have it and he will not give me it unless I go for child support and do a dna test the problem I ran into is with my hubby signing the papers I can't take him for child support unless I take my hubby for child support and see if the judge will let us do I dna test to undo the papers my hubby signed and then I can go afer her bio father what r the chances of the judge doing that?

I wonder if he even has this "medical stuff" (medical records, perhaps?) you seek.

You don't really want to change the birth certificate or get child support from him, do you? As I read what you have written, you have been told that going for child support is the only way to get the medical information. This is not necessarily correct.

Rather than possibly getting your husband in trouble for perjury, I suggest that you simply bring an action against this man, explaining the medical questions and that you think he may be the biological father, asking for an order requiring him to submit to a paternity test. You might expain to him that you don't want the child support, and don't ask that the results be submtted to the court. That way he should be less hesitant to submit to the test.

Getting child support and filing for paternity from him will not get you his medical records.
You should be able to get a court order for his medical records by just going to court to demand them. Also have you talked to his parents ?

Also exactly what do they expect to find ? Have you considered other doctors since they should be able to find what is the issue.

Ok, but don't open a can of worms. You and your husband should simply sit down with her and tell her who her biological father is. But don't open up the birth certificate, child support, and even visitation rights issues, with the excuse that you "need" medical records. If you really need them (I too question what it is the doctors would discover by going into this.), leave it at that.
