    On L1, Spouse and kid on L2 , should I apply for ITIN or SSN
    Hi ,

    I have few of questions

    1. I am on L1 and my spouse and 18 month kid are on L2. Can I apply for their SSN or I should apply for ITIN.
    2.In future my wife may work , and then she will applying for EAD and then get a SSN . Is it possible to get a SSN after getting ITIN.
    3.We came US on 2September, now is my status a Resident Alien or non Resident Alien .Does this impact the amount of tax I pay.

    1) Always try to get the SSN first. Apply for the ITIN when you KNOW that you cannot get a SSN.

    2) Yes. The ITIN is supposed to be a temporary solution.

    3) You are in resident status, but NOT for tax purposes. You cannot file jointly with your spouse and choose resident status until late May/early June. Filing jointly as residents give you a double Standard Deduction of $10,300, something you will NOT get if you file dual-status or non-resident alien.

    Thanks, for the answers , but I am not clear on the 3 answer , So how should I file the tax, as joint, indvidual, Or what is the Standard Deduction in my case. In form 1040A I don't see any column which asks for Resident status.

    Can you please clarify my dobuts.Thanks again .

    You will file jointly and attach a statement to the return telling the IRS you are eligible to file jointly and that you want to be considered as resident aliens for ALL of 2006.

    If you file jointly, your standard deduction will be $10,300.
