    How to gain custody or legal guardianship of our "son"?
    My husband and I are in a difficult situation and need some advice before we contact an attorney. Here's our story:

    We have a 10 y/o who has lived with us since July of 2011. We have poa papers with the right to deal with medical issues and school related issues but no guardianship or custody. He is my husbands ex-wifes son and she can't and doesn't want to raise him and gave him initially to his aging grandmother who in turn called us and asked if we could take him Of course we agreed and we bought him a plane ticket from dallas to Little Rock. His "mother" has had contact with him through phone calls, which we now agree that we should have not let her, but she always threatened to come take him from us. She won't give us guardianship or custody and she is now facing 15-20 years imprisonment for drug charges and federal charges. His biological father is already in prison but is being released in April of this year and is now saying that he wants his son. He has never had anything to do with his son when he lived in Texas with his "mother". Both grandparents say that he should stay here with us and that he is healthy and happier than they have seen him in a long time. He wants to stay with us also. We are afraid to start legal action in fear that the state will want to put him in foster care until all this is resolved. We loved our son with all our hearts and want to keep him forever.

    Now that you know a little about our situation, what are we up against? Do we have a leg to stand on? How do we stop either of his parents from taking him from us?
