    Property owners rights ,
    My grand son lived with me until late jan 2012. I moved feb 15, 2012 and put the house up for sale . On march 6,2012 he ended up with no where to live so he decided to move back in my house . The police came and said because he had a pice of mail at that address ,I would have to evict him. The locks had been changed so I am not sure how he got in.is there any thing else that can be done?

    Hello in:

    You can inform the cops that he was already OUT and broke in. Or, you can evict him. If you're efficient, it'll take about 3 weeks.

    Where is this home located? I like Excons first thought, especially if he broke into the home. BTW the police are not lawyers, their logic may be based on only circumstancial info and not valid.

    It just comes down to it is easier for the cops to do nothing.

    You're going to have to evict him following normal eviction procedures. It starts with you documenting in writing that you want him out immediately, and then you can get a court order to force him out within 30 days.

    The fact that he has received mail there means that he claim that the house is his home, and even though you consider him a trespasser the sherriff will not intervene without the court order. The cops will not risk their careers forcibly evicting someone just on your say so.
