    No. As soon as he starts kicking you, call the police and have him arrested for assault and battery.

    So who has filed for divorce at this time,

    But no he can not throw you out, or kick you out. If he starts throwing your things out, you again call the police for damage to your property. Document all of it, to use against him in divorce court.
