    Visitation Rights
    How would a father get visitation if jurisdiction is in another state? There is no current custody or visitation order only child support (parents were never married) Paternity has already been proven.

    The father files in court for visitation.

    What state does the father live in?
    What state does mother and child live in?

    What state is the child support order?
    Most likely that would be the state you file for visits in. but a little more info will help

    He lives in Rhode Island. She lives in Florida. The child support order was for the state of Oklahoma in which we previously resided.
    They lived in Rhode Island together for three years. They had a child at the time and she told him about the second after she took off. Can he file in the state he is in for the state of jurisdiction or does he have to be present in that state? Also how likely is it for him to get out of state visitation during the summer considering they are so far away and weekend/weekday/holiday visitation is highly unlikely and finacially unreasonable? He hasn't seen his daughter in two years and has yet to see the other.

    Florida has jurisdiction so he needs to file there. He can hire a RI attorney who will work with a FL affiliate. He can request to appear by telephone.

    Thank you for adding more info, it was very helpful, Scott is correct you will file in Florida for visitation. You can hire a Fl attorney over the phone, drive down and talk to several or as Scott said, hire a local one, who will work with one there.
