How to evict my son his wife and grand daughters from my rental property.
This just breaks my heart but I feel so used by my own family. Thirteen years ago I let them rent a 3bd house for just $300 dollars. ( Normal rent is $1,200) I got rent for a few months and his wife declared they should not pay rent. She has her family from Chicago stay there. All for free while the house deteriorates. All I ask is for $300 monthly to cover the taxes for November. I pay for the insurance which is sky high because they have 3 Pitt bulls. I lost my business in 2007. And live off my savings only. The only income came from this property. They only call me to borrow money or take care of the girls. I feel no love whatsoever from their part even though my son swears he loves me. But when I had surgery no one came to see me over 6 months. They don't live far away just the hassle of traffic. I know its difficult for my son to go against his wife's wishes to not pay and I don't want my grand daughters to hate me by evicting them but its going on 14 years now. Please advise.

You evict them the same way you do anyone that is not paying.
In this case, since they have been living free for so long. I would give them written notice that rent is to be ( and if they are working make it realistic rent) if they don't start paying, you give them a eviction notice. If they don't move out, you file for eviction in housing court.

You don't say of your son is working or if her family has an income.
Assuming they do, I would do similar to what Chuck suggested. But what I would do is prepare a lease with a reasonable rental. I would present them the lease and tell them If they don't sign it and start paying rent on 3/1 then you will proceed with eviction proceedings.
These people don't deserve how nice you have been to them. By my reckoning they have cheated you out of over $200,000. Its time to stop being Mr Nice Guy and play hardball.

Thank you for wanting to help our members. However, as you are new here you may not be aware of some of our standards. This is the Real Estate Law forum.
