    Can I terminate Non- Custodial parents visits?
    I have soul custody of my child his father has a court order that allows him supervised visits by me once a week for 3 hrs, he moved away in about 10/2010 and has not made any visits since, but once in 02/2011 and that was because we had a court hearing, besides than nothing until a new hearing this month. He is also serving a sentence of 5 years probation in his current city of residence for driving with a suspended license under the influence, and is living in a half-way house. So can I terminate his visitation rights, because he has made no effort? And continues to live an unhealthy life-style?

    You'd need to file in court for this, but you might be successful. Call a lawyer and find out what the laws are in your state on this.

    You personally can not terminate his visitation, the Judge has to do that. You said supervised visits, is that done through a visitation Center? If so, keep setting up visitations as if you believe he is going to show up. Document each time he fails to show up for a Court Ordered visit. Ask the person doing the supervised visits to make a recommendation to the court because he is failing to keep his ordered visits. I am not an attorney and this is not legal advise.

    As noted, only a court can terminate a court order. If you feel a modification should be made to the current order, then go to court and file for a modification.
