    Change name on house deed
    My husband's deceased first wife's name is still on the deed to our house. How do we change her name to mine? Is it necessary? They had 2 children, now grown.

    If your husband owned the house with his late first wife as joint tenants, and if he wants to make you co-owner of the property, and if there is currently no mortgage on the property, then he would have to prepare a deed with himself as seller, transferring to himself and to you, as buyers. Then the deed would have to be recorded.

    If there is a mortgage on the property then he would need the approval of the lender before making these changes and the lender would probably require a modification to the mortgage.

    If your husband wants to do this then I suggest you have this handled by an attorney or title agency. It shouldn't be expensive and it will insure that it is done properly. If you do it yourself and make a mistake it can be very expensive to fix.
