    I have joint custody of my children with my ex and she is moving to Seattle
    Our shared custody set in a court order has been Sunday to Sunday alternating weeks since 2005. We just recently have been in court to determine who would get primary because she wants to move to Seattle to be with her new husband. We reside in Las Vegas, NV. Just recently over the holidays she stated she was going to give me primary custody of the children so she could be with her husband and that her lawyer is preparing the paperwork. She stated that on 12/18/2011 she moves on 1/7/2012 I already have the children living with me fulltime since 12/29/2011 but no paperwork has materialized. I asked her about it and she stated that her lawyer is working on it and I should not worry since the kids wouldn't come visit her yet till February during Presidents day weekend and that the paperwork would be completed before then. My questions is can she just leave like that with no paperwork set in place? I don't trust her, so I worry and do I have any recourse?

    Do you have a lawyer in place to follow up for you? I would think she could not leave until all is finalized between you. I guess in this case you cold call it abandonment.

    You need to have your lawyer, to first review anything her lawyer does.

    What happens on the 6th, if she picks up the kids and leaves and you don't even know where they are at?

    You need to be the one filing for custody of the kids. And this will modify with her only having visitation.
