    Are stepchildren entilted to socialsecurity disability paid to deceased father?
    My mother gave birth to four children before marrying my dad in the 60's. Nov. 1972 they gave birth to a daughter. She is the only biological child in this 35 year marriage. 2005, my mother died of cancer and 2008 my father died of cancer as well. They both died Intestate with all living children over the age of 30. Two years before my dad died he had filed for his disibility and it was approved a week before he died. My youngest sister (biological) filed out the paper work and did not include any of the four other sibilings (stepchildren). The form clearly says to list all adopted children, stepchildren , etc. I was five when my parents married and that is the only father I have ever known. I don't feel that it was right of her to take everything and not give us a dime. Were we entitled to anything? My father received about $20,000.00.

    What state did he die in?
    Were you adopted by him?
    Has his bio daughter applied to be executor?
    Have you notified SS?

    My father died in Alabama, his place of residence. I was not adopted, my mother and stepfather married in 1969 when I was 6 years old. Death departed my parents. My sister (biological) was born in 1972. I don't know whether she applied to be executor. I contacted social security and they gave me a form to fill out that specifically says list all living children, adopted children, step children etc.. I have been given instructions to mail in a copy of my birth certificate along with my parents marriage certificate to establish me as a daughter in the marriage.

    All 4 of you stepchildren don't inherit under Alabama law because you weren't adopted by your father, your mother died first, and your dad left no will (I'm sorry).

    But I am not sure how SS will treat this. I hope you find out soon, and answer back.
