    Animal cruelty loopholes?
    Question for excon: My boyfriend was drunk, incapacitated, he didn't know what he was doing. He killed my dog and they got him for torture. Is there a loophole to help him out?

    Interesting, what form of torture did he use, and what kind of dog, young dog, puppy, old dog, please give us all the gory details my friend, anxious to hear. Why would you direct this to excon in particular, as this very esteemed member of our forum is probably not tweeked on dog torture legislation.

    Your post interest me for one or two reasons.

    I will agree, abuse to animals is normally just a normal stepping stone to abuse of spouse or children.

    Also as silly to some as it sounds, he is very more likely to get into more trouble in animal abuse as he would spouse abuse since the spouse normally feels sorry for him and won't testify, but a abused animal ( or dead one) with all the photos for the jury, will have the jury crying.

    So while personally I want a person who abuses animals to get the max. A defense :
    1. do not admit to even doing it, do not confess.
    2. Hire an attorney who will try and get any evidence thrown out for various issues with collection, chain of evidence and so on.
    3. if he was drunk when he was questioned by the police try to get his confession throw out because he did not understand his rights.
    4. If you go to court ask for a bench trial, not a jury, you don't want a jury getting emotional, the judge will rule normally just on the law and has seen all sorts of abuse and crimes.
    5. see if the attorney can make a plea deal

    But my advice is the same as above, run from this relationship, if my partner had done this, I would never be able to sleep with them in the house, from fear of them.
    Which is what most courts and jury will think

    You don't understand he's not like that he did not mean to do it. It was a accident he fell on her I tried to tell them that cops don't listen. I was reading this web site a bit ago that's why I ask for him he answered a lot of questions.

    Sorry, don't believe you, they could have charged improper disposal or dead animal, or causing the death of an animal.

    But to charge torture there had to be signs of abuse, or statements of abuse by someone.
    Also what type of dog, since just falling on a dog may harm them but seldom kills them.
