How long does it take to settle a under insured claim once the attorneys for my insurance company has all requested info and then some, recorded statement, medical records for the last 8 years which proves no pre-condition, bills, discovery, copy of my passport(yes) etc. Do people accused of murder have to jump through hoops like this? Still don't know if they are going to request a deposition. I spent a night in the ER, x-rays, MRI's, already seen two doctors and both agree on my condition, post accident, present and future care and needs.

I'm willing to see their doctor for a 3rd opinion. What about arbitration?. 30 days, 60 days or longer to review all and make a offer or just plainly say no or what? Isn't there some standard time line by law? We formally notified them 5 months ago about the claim and I have attorney.

I was rear ended and its about clear cut and dry as it come with him being 100% at fault... his insurance company paid out his max 15K without blinking which didn't ever begin to cover my losses... why the hell is it taking my insurance so long to pay out on my policy to cover the rest so I can get back to work and get on with my life? I live in California where 50% of the drivers on the road have no insurance... this is why I paid for this coverage... I don't want to push and seem desperate... but over it. Got to be some kind of limit on how long the can drag this out... at what point do I tell my attorney to file for bad faith or breach?

They can take as long as they want, they can deny the claim and drag it out of years if they want. I had one claim that took 8 years and settled in the back of the court before the case was to begin.

Thanks.. but I did find regulations and guidelines on the State of California Department of Insurance that they must adhere to. The more games they play the more they are going to pay me. My claim is just and I paid for the coverage. I have a great attorney and I'm white, educated, well spoken and have the money and time to fight the bastards in arbitration and or court as long as it take... the longer the better cause means more money and that the best way to hurt them. The reason I state all this is cause they asked... basically to see if I have the IQ, money and balls to shove it up their ***.. bring it!
