    What is the Florida law for removing a house guest ?
    What can I do to remove my goddaughter from my home? I didn't ask for rent and there is no lease agreement just helping her out with a place to stay. She has been here 3 months and I want her to leave by Wednesday but she says she needs more time and I said no but she refuses to leave. What do I do? Call the police or what?

    Unless she is doing something criminal that would involve the police, you have to evict her like a tenant, whether she pays rent or not. Give her notice in writing, with a witness, first. Call your town hall to find out where to start formal eviction.

    Someone residing in your home for 3 months is no longer a guest but a resident. As a resident, they have to be removed according to the eviction process for your area.

    Without a lease, she is considered a periodic tenant. In Florida that means you can give her a 14 day notice to vacate. This has to be a written notice. If she fails to leave by the deadline, then you need to go your local housing court for an eviction order.

    The fact there is no written rental, or the fact she does not pay rent, are not issues. If she had stayed three days, it would be one issue, but after three months she is a resident and has rights. You will have to give her a 30 day written notice to move. If she does not move then, you still don't call the police, but go to court for a eviction though the court.
