Hi,

Please would you be able to advise me on some charges I am facing?

I got in a fight with a taxi driver, this started after a struggle with him biting me. I have hit him and unfortunately broke his jaw. I also grabbed a police officer after. He is also accusing me of shouting racial names at him during the fight.

At the time I was drunk and acting out of character, I have admitted this during a police interview.

I am being charged with Assault and battery, is this a likely custodial sentence?

Uhhh, maybe... You hurt somebody, badly..

Having said that, your sentence is NOT written in stone.. In this country, we have the finest justice system money can buy. People who have GOOD lawyers get GOOD justice... People who don't, get bad justice, if you want to call it justice.

Do you get my drift?

First you know in 50 plus years of riding in a taxi, none of their drivers ever tried to bite me. So obviously you did something to make him do that, so we are not getting the full story.

But anyway, I will assume you have paid all of the taxi drivers medical bills, since that will go a long way in court to prove you are sorry for what happened. I will also assume you went into some program like AA where you can show the court that you have stopped drinking.

And since you did not mention assault on a police officer, just the assault on the taxi driver, it is not as bad.
If they charge you with both, you will be in a much more serious place. Nor did I see resisting arrest charge.

But yes it is possilbe to do jail time for any of this, and you need a very good attorney.

Which could make it a "hate crime", also enhancing the sentence.
