How should I got about filing a lawsuit against Child and Family services?
I am 20 years old and had been in cfs for the last 6 years of my life. I can't even begin to type what abuse and mistreatment that I have gone through. I am filing a lawsuit against cfs and am wanting to tell my issues to someone who understands other than my lawyer and foster mom so that what happened to me doesn't happen to other kids. Ill give you a bit of an idea I got taken away from my mom when I was 13 because her boyfriend sexually molested me. I was put into care with my aunt who lived in stonewall Mb but was in a very disfunctional marriage after 5 months of being placed in my aunts who's husband was a heavy drinker and emotionally abusive to my aunt he took off to work and left my aunt , little cousin and I after constant threating of leaving. My aunt was unstable because of the mental and emotional abuse. One day I came home from a school hockey game to find my little cousin out of breath because my aunt had attempted to end her life. My 7 year old cousin ran 2 miles to the nearest nieghbors. Couldn't call 911 because the phones were ripped out of the walls and when I got home it was late and police had come and gone already. I was left to read my aunts suicide letter in which you could tell when the temazapams and other pills started to kick in because the lettering was all scribbly. I had no socail worker at that time and had to find a friend in a new town where I could stay so I didn't have to go to a group home. After my aunty was out of the psych ward we couldn't go back to the house because my uncle was there and so we had to stay at nova house in selkirk a women's shelter for 2 months. I didn't attend school during that time. When we went to go get some of our stuff we went to go and check on the horses, barn cats and other farm animals which were not being fed and malnourished. The barn cats had turned cannibalistic and the horses eyes were sunken in from dehydration, mutiple dead chickens and I was with my aunt when we went to go get all our stuff. Later on after we moved back to the house and noticed something was strange but couldn't quite figure it out. One day we came home from hockey practise my aunt, cousin and I to find my uncle in the porch unconscious. He parked his truck in an abandoned house 3 miles away from our house walked through the fields in the middle of the winter and we had found out he was staying in the hayloft in the barn. We found binoculars, food, alcohol, portable dvd player , blankets etc. showing that he had been there for who knows how long. During that whole period I didn't have a socail worker or even checked on by the agency. I have so much more to say so if you could email me back that would be amazing. I know so many more kids have gone through hardships and are traumatized and left high and dry from cfs. I need to involve and exploit my story . This is only a little bit of what I have gone through there is so much more to say. I also never received any programs like the Laurel Center for Sexual Abuse, I had to find my own places because my worker told me "No one will take a 16 Year old sexually abused girl, its a big thing to take on".

You assume that C&F S is to blame for failing to intervene in all of this. But what evidence do you have that they knew about the problems you describe?

So how many times did you report this to the police, how many times did you call and report it to the hotline.

CPS ( or what ever they are called in your area) places you with family often and that is it, there is no case worker, there is no follow up until there is a new report or court action.

Since you have engaged an attorney, what has your attorney told you about your chances?

As both AK and Chuck have pointed out, proving malfeasance on the part of CPS will be difficult.

I hope telling part of your story here helps you vent some of your (understandable) rage and anger. But I don't see a question here. The purpose of this site is more to ask and get answers to a question.
